Evaluating a carrier’s or shipper’s compliance with the Hazardous Materials Regulations.
This includes a review of the full range of requirements for packaging, marking, labeling, routing, driver compliance and carrier/shipper responsibilities.
RISK ASSESSMENT AND SECURITY PLAN REVIEW AND DEVELOPMENT
Helping carriers to assure that they are in compliance with the FMCSA’s transportation security requirements.
This evaluation provides a second set of eyes to assess vulnerabilities of which the company may not be aware. This review includes development of risk assessments for each of the company’s facilities and, based on the assessments, a comprehensive security plan.
ECONOMIC REGULATION REVIEW AND AUTHORITY ASSISTANCE
Providing assistance with economic issues.
This includes assisting motor carriers in obtaining their authority and US DOT number, evaluation of the carrier’s operating authority to assure it is adequate, and tracking authority status to help identify any potential problems that may arise.
PREPARATION FOR NEW ENTRANT AUDITS
Preparing new motor carriers for their New Entrant Audits.
With the implementation of FMCSA’s New Entrant Program there is greater urgency that new motor carriers obtain compliance as soon as possible. Failure of a New Entrant Audit ends a motor carrier’s ability to operate in interstate commerce. Program changes are in process which will make it more difficult to pass the audit. Be ready for the visit!
HOUSEHOLD GOODS REGULATION REVIEWS
Assisting household goods carriers in complying with FMCSA’s regulations specific to their part of the industry.
Since termination of the ICC this segment of the industry has continued to draw increased interest from the public, the news media and the US Congress. This has resulted in both funding and a mandate for FMCSA to enforce the regulations. This has also resulted in higher penalties when violations occur. In 2005 the number of Compliance Reviews performed on household goods carriers greatly increased. That emphasis continues in 2006. The odds of your being subject to a review and potential penalties have grown.
REPRESENTATION OF COMPANIES DURING U S DOT REVIEWS
Representing motor carriers and shippers during US DOT and state Compliance Reviews and New Entrant Audits.
This assists in identifying if problems exist which might lead to penalties and to assess what actions can be taken to potentially reduce or mitigate those penalties.
ASSISTING CARRIERS WITH RESPONSE TO ENFORCEMENT ACTIONS
Assisting motor carriers and hazardous materials shippers who have become subject to enforcement actions in exercising their statutory rights.
The issuance of a Notice of Claim is a beginning, not an end. Having a knowledgeable representative during this process has the potential of saving a company money and image through utilization of the statutory rights provided to the carrier or shipper.
MANAGEMENT AND EMPLOYEE TRAINING
Providing training to management and employees regarding how to comply with the Federal Motor Carrier Safety Regulations (including where applicable economic and household goods) and the Hazardous Materials Regulations.
Knowledge is the first step towards compliance and staying out of trouble with the US DOT. A full range of training is available and can be tailored to your needs. In addition, training can be scheduled to meet your operational needs. If you need the training provided at night or on a weekend, that can be arranged.
Providing expert testimony.
Although no one looks forward to going into court, having someone with the background and expertise to discuss the regulations and DOT compliance and enforcement programs and procedures can offer a certain degree of comfort.
